Attached is the text of what the sponsors of a bill in the Colorado legislature proposing the outlawing of the sale of what they define as so-called “assault weapons”  In addition to nonsensical and factually incorrect hyperbole in the preamble to the actual definition, here are some of  the features  the bill’s sponsors  define as classifying a firearm as an “Assault weapon:

(I) A SEMIAUTOMATIC RIFLE THAT HAS THE CAPACITY TO ACCEPT A DETACHABLE MAGAZINE, OR THAT MAY BE READILY MODIFIED TO ACCEPT A DETACHABLE MAGAZINE, AND HAS ONE OR MORE OF THE FOLLOWING CHARACTERISTICS: 

(A) A PISTOL GRIP;  

(B) ANY FEATURE CAPABLE OF FUNCTIONING AS A PROTRUDING GRIP THAT CAN BE HELD BY THE NON-TRIGGER HAND;  

(C) A FOLDING, TELESCOPING, THUMB HOLE, OR DETACHABLE STOCK THAT IS OTHERWISE FOLDABLE OR ADJUSTABLE IN A MANNER THAT OPERATES TO REDUCE THE LENGTH, SIZE, OR ANY OTHER DIMENSION, OR 

OTHERWISE ENHANCES THE ABILITY TO CONCEAL THE WEAPON;  

(D) A FLASH SUPPRESSOR;  

(E) A FUNCTIONAL GRENADE LAUNCHER;  

  1. F) A SHROUD ATTACHED TO THE BARREL, OR THAT PARTIALLY OR 22 COMPLETELY ENCIRCLES THE BARREL, ALLOWING THE BEARER TO HOLD 

THE FIREARM WITH THE NON-TRIGGER HAND WITHOUT BEING BURNED, BUT  EXCLUDING A SLIDE THAT ENCLOSES THE BARREL; OR  

(G) A THREADED BARREL;  

(II) A SEMIAUTOMATIC RIFLE THAT HAS A FIXED LARGE-CAPACITY MAGAZINE, AS DEFINED IN SECTION 18-12-301; -6- HB23-1230 1  

(III) A .50 CALIBER RIFLE; 2 

 

(IV) A SEMIAUTOMATIC PISTOL THAT HAS THE CAPACITY TO ACCEPT A DETACHABLE MAGAZINE, OR THAT MAY BE READILY MODIFIED TO ACCEPT A DETACHABLE MAGAZINE, IF THE SEMIAUTOMATIC PISTOL HAS ONE OR MORE OF THE FOLLOWING FEATURES: 

 

(A) A THREADED BARREL;  

(B) A SECOND PISTOL GRIP OR ADDITIONAL FEATURE CAPABLE OF 8 FUNCTIONING AS A PROTRUDING GRIP THAT CAN BE HELD BY THE NON-TRIGGER HAND;  

(C) A SHROUD ATTACHED TO THE BARREL, OR THAT PARTIALLY OR COMPLETELY ENCIRCLES THE BARREL, ALLOWING THE BEARER TO HOLD THE FIREARM WITH THE NON-TRIGGER HAND WITHOUT BEING BURNED, BUT 

EXCLUDING A SLIDE THAT ENCLOSES THE BARREL;  

(D) A FLASH SUPPRESSOR;  

(E) THE CAPACITY TO ACCEPT A DETACHABLE  AMMUNITION-FEEDING DEVICE AT SOME LOCATION OUTSIDE OF THE PISTOL GRIP;  

(F) A MANUFACTURED WEIGHT OF FIFTY OUNCES OR MORE WHEN UNLOADED; OR (G) A BUFFER TUBE, ARM BRACE, OR OTHER PART THAT PROTRUDES HORIZONTALLY BEHIND THE PISTOL GRIP;  

(V) A SEMIAUTOMATIC PISTOL THAT HAS A FIXED LARGE-CAPACITY MAGAZINE, AS DEFINED IN SECTION 18-12-301; 

 

(VI) A SHOTGUN WITH A REVOLVING CYLINDER; 

 

(VII) A SEMIAUTOMATIC SHOTGUN THAT HAS ONE OR MORE OF THE FOLLOWING FEATURES:  

(A) A PISTOL GRIP; -7- HB23-1230 1  

(B) ANY FEATURE CAPABLE OF FUNCTIONING AS A PROTRUDING GRIP THAT CAN BE HELD BY THE NON-TRIGGER HAND;  

(C) A FOLDING, TELESCOPING, OR THUMBHOLE STOCK;  

(D) A FUNCTIONAL GRENADE LAUNCHER; 5 (E) A FIXED LARGE-CAPACITY MAGAZINE, AS DEFINED IN SECTION 6 18-12-301; OR  

(F) THE CAPACITY TO ACCEPT A DETACHABLE MAGAZINE;  

(VIII) A SEMIAUTOMATIC FIREARM THAT HAS THE CAPACITY TO  

ACCEPT A BELT AMMUNITION FEEDING DEVICE;  

(IX) A SEMIAUTOMATIC FIREARM THAT HAS BEEN MODIFIED TO BE OPERABLE AS AN ASSAULT WEAPON AS DEFINED IN THIS SUBSECTION;  

OR ANY PART OR COMBINATION OF PARTS DESIGNED OR INTENDED TO CONVERT A FIREARM INTO AN ASSAULT WEAPON AS DEFINED IN THIS SUBSECTION, INCLUDING A RAPID-FIRE TRIGGER ACTIVATOR OR ANY COMBINATION OF PARTS FROM WHICH AN ASSAULT WEAPON MAY BE READILY ASSEMBLED IF THOSE PARTS ARE IN THE POSSESSION OR UNDER THE CONTROL OF THE SAME PERSON. 

 

(b) “ASSAULT WEAPON” DOES NOT INCLUDE ANY FIREARM THAT HAS BEEN MADE PERMANENTLY INOPERABLE; AN ANTIQUE FIREARM MANUFACTURED BEFORE 1899; A REPLICA OF AN ANTIQUE FIREARM; A FIREARM THAT IS MANUALLY OPERATED BY BOLT, PUMP, LEVER, SLIDE ACTION, UNLESS THE FIREARM IS A SHOTGUN WITH A REVOLVING CYLINDER; OR A FIREARM THAT CAN ONLY FIRE RIMFIRE AMMUNITION. 

 

(3) “DETACHABLE MAGAZINE” MEANS AN AMMUNITION-FEEDING DEVICE THAT MAY BE REMOVED FROM A FIREARM WITHOUT DISASSEMBLY OF THE FIREARM ACTION, INCLUDING AN AMMUNITION-FEEDING DEVICE -8- HB23-1230 1 THAT MAY BE READILY REMOVED FROM A FIREARM WITH THE USE OF A  BULLET, CARTRIDGE, ACCESSORY, OR OTHER TOOL, OR ANY OTHER OBJECT THAT FUNCTIONS AS A TOOL

END NOTES:

So by banning any rifle that has a detachable magazine plus either: 

  • Barrel Shroud 
  • Pistol grip 
  • Adjustable stock 
  • Flash suppressor 

It would basically ban the sale of all AR-15 type rifles in Colorado. 

With regard to pistols, no pistol  that has a threaded barrel that allows for the addition of a suppressor would be legal.

With regard to shotguns, any semi-automatic shotgun with a detachable box magazine or fore-end pistol grip would also be considered to be an assault weapon.
